Participation Agreement
I am signing this Agreement in consideration of my participation in the Youth Court Summit that has been arranged through the California Association of Youth Courts. In this Agreement, the terms “I” and “my” refer to the participant, and the terms “you” and “your” refer to the California Association of Youth Courts.
Waiver
Hold Harmless and Indemnity. As a condition of my participation in the Youth Court Summit, I waive any injury, damage, loss, cost, or expense, including attorney fees and costs, incurred by me whether or not they arise out of the Youth Court Summit programs or other Youth Court Summit activities, including recreational activities, except to the extent they are caused solely by your gross negligence or intentional misconduct. I also hold you harmless and will indemnify you against any injury, damage, loss, cost, or expense that my participation in the Youth Court Summit programs or other Youth Court Summit activities, including recreational activities, causes you or any third party to incur. But my agreement to hold you harmless and indemnify you does not extend to damages, losses, costs, or expenses to the extent that they are caused solely by your gross negligence or willful misconduct. If I do not wish to incur these risks with respect to my participation in any program or activity, I understand that I may opt out of participating in the program or activity and I will do so accordingly.
Use of Participant’s Name and Likeness. I consent to and authorize your use of my name, photograph, file, or video likeness, and any comments or statements made by me, for any lawful purpose. Any request to be excluded from media need to be conveyed in writing to the CAYC Summit Chair Coordinator.
Problem Notification and Resolution. I acknowledge that participants cannot be continually supervised or controlled by you, and I agree to advise you of any significant problems, such as concerns about health and safety. Also, upon your request, I agree to terminate my participation and depart if I violate any terms and conditions in this Agreement or the Rules of Participation outlined in Part 6.
Entire Agreement; No Waiver. This Agreement may not be modified except by a writing that is executed by you and me.
Severability. If any clause, sentence, term or provision of this Agreement is illegal, invalid, or unenforceable, the remaining portions of this Agreement will remain in full force and effect.
If signed by the participant, that participant certifies to having read it and understood it, to be legally bound, mutatis mutandis, to all terms and conditions in it that apply to the participant’s participation.
CODE OF CONDUCT
Remember: All decisions and choices do have an effect on you and others, and they do have respective consequences. The hope of the summit staff is that all participants will conduct themselves in a manner that will reflect honor on themselves, their youth court, and the summit.
This Code of Conduct, governing program activities and events, shall be discussed with adult leaders and youth at the beginning of the summit. Codes of conduct rely in great part on the character and judgment of all the participants.
CODE OF CONDUCT (For Youth and Adults)
- Youth are expected to attend their assigned sessions and workshops. Youth and adults shall be on time in their attendance.
- While at the summit, all participants are expected to exhibit positive character and behavior including (but not limited to) trustworthiness, responsibility, respectfulness, caring, good citizenship, and fairness.
- Youth are expected to be responsive to the reasonable requests of the leaders and staff at the summit.
- All persons should be aware and respectful of the needs for their own personal safety and the safety of others.
- All persons should adhere to the quiet hours of the campus, staying considerate of noise and other groups that may be on campus.
- All participants must dress appropriately for the respective summit activities. A good guide would be: “If you couldn’t wear it to work at a court, it isn’t appropriate.” Social and athletic events are more casual but attire appropriate for the activity is still required. If in doubt, ask a leader or staff member. REMEMBER: Pajama pants, exposed underwear, bare midriffs, revealing tops, tank tops, see-through jerseys, short shorts, skirts more than 3” above the knee, gang related wear, and clothing with inappropriate words or art are never allowed.
- All participants are expected to use appropriate language and respect the rights and opinions of others.
- Youth may not use or possess alcohol, drugs, or tobacco, including vaping or medical marijuana, or associate with or remain in the presence of others using these substances. Prescription drugs may be used in accordance with a valid medical prescription if fully disclosed to the leader of the youth’s court program in advance.
- No person may possess or use any deadly or dangerous weapons.
- All participants are to remain on campus at all times unless they are part of a summit-sanctioned off-campus event or have specific prior approval from the president of CAYC.
- Outside ordering of food is prohibited. (No delivery service)
- No participant may behave recklessly, engage in sexual conduct (consensual or otherwise), assault, threaten, or harm another person, nor may they misuse, abuse, or damage public or private property.
- All dorm rooms are assigned and you cannot change rooms without permission from CAYC Summit Coordinator. All youth shall remain in their own specified dorm areas or areas designated for communal use; at no time shall the youth be in a room they are not assigned.
- If the campus has a pool, the use of the pool is prohibited.
- Youth or adults who observe a breach in the Code of Conduct shall report the misbehavior to the appropriate leader or staff member.
- Realizing these standards may not cover all situations, the Board of Directors of CAYC reserves the right to make adjustments to these policies.
Violations of the Rules of Conduct
- Violations of the Code of Conduct will be addressed by the president or members of the Board of Directors of CAYC who are attending the Youth Summit.
- Matters deemed a minor violation of the Code may be addressed by the president of CAYC. Matters deemed a serious violation of the Code shall be addressed by the members of the Board of Directors of CAYC who are attending the Youth Summit.
- Consequences for violations may be imposed in the discretion of the president and board members, and may include, but are not limited to
- Counseling the offender
- Referral of the offender for disposition by the offender’s youth court program.
- Restriction of activities at the youth summit.
- Confiscation and destruction of any items possessed or used in violation of this Code.
- Suspension from participating in CAYC future activities for a period as may be determined.
- Notification of the offender’s parents.
- Immediate return of the offender to his or her home, at the expense of the parents.
- Limiting or prohibiting the participation of the offender’s youth court program in future youth summits.
- If a crime has been committed, referral to the appropriate law enforcement agency.
By signing this agreement you agree to abide by this code of conduct and to help hold youth accountable to the above code of conduct.
